New Jersey DOL Worker Misclassificaiton Compliance Update
In an ongoing effort to curtail employee misclassification, Governor Phil Murphy of New Jersey signed a legislative package of six laws at the beginning of the year including Assembly Bill 5843 which requires New Jersey employers to conspicuously post a notice on misclassification.

 

A report published in 2019 by Governor Murphy’s Misclassification Task Force found that employee misclassification has risen by a whopping 40% in the last 10 years.

 

In May, the New Jersey Department of Labor posted the required Notice to its website in an 11×17 PDF and an 8×11 PDF.

 

New Jersey employers should print out the notice from the New Jersey DOL website and post in each New Jersey place of business. Although the law does not address guidance for electronic posting in light of current working conditions, it is encouraged to post the notice online or to send the notice through email to all New Jersey-based employees.
